Referral Program Terms

These terms govern the TradieBuddy AI referral program. By creating a referral link you agree to them. In short: share your unique link, and if someone you refer becomes a paying client, you earn a 15% referral fee on the fees they pay us for their first engagement, paid to your bank account after the payment has settled and a short holding period has passed. Please read the detail below.
1. Who we are
This program is operated by Tradie Buddy AI (ABN 13 220 178 522), a sole trader based in Australia ("we", "us", "our"). "You" means the person who creates a referral link and takes part in the program.
2. Who can take part
- You must be at least 18 and provide accurate contact details when you create your link.
- You may take part as an individual or on behalf of a business.
- You cannot refer yourself, your own business, or an entity you control, and you cannot refer someone who is already in discussions with us or is already our client. See section 9.
- Taking part does not make you our employee, agent, partner or representative, and it gives you no authority to act or speak for us (see section 12).
3. How you earn a fee
You earn a referral fee when all of the following happen:
- someone reaches us through your unique referral link (a "referred person");
- that referred person becomes a paying client of ours; and
- they pay us in full for their first paid engagement, and that payment settles (clears) into our account.
We attribute a referral on a first-touch basis: the first referral link a person uses is the one credited, and this cannot later be changed to a different referrer. A referral fee is a one-off amount for a referred client's first engagement; it is not an ongoing or recurring commission.
Referral tracking relies on a small identifier stored in the referred person's browser and on their enquiry record. If that identifier is missing, blocked or cleared (for example, by their browser or privacy settings), we may be unable to attribute the referral, and no fee will be payable.
4. The fee
The referral fee is 15% of the fees the referred client pays us for their first paid engagement, calculated on the amount actually paid and settled. It is paid in Australian dollars.
We do not publish our client pricing, and taking part in the program does not entitle you to it. Your fee is simply 15% of what that client actually pays us for that first engagement.
5. How and when you are paid
- A fee becomes payable only after the referred client's first payment has settled and a 14-day holding period has passed (this protects against refunds and chargebacks, see section 7).
- To be paid, you must give us valid Australian bank details (account name, BSB and account number) and complete the tax step in section 6. We collect these at the time a fee is first payable, not when you sign up.
- We pay by electronic funds transfer (EFT) to the account you provide. We may pay approved fees in periodic batches, and we may hold a small balance until it reaches a minimum payout amount before releasing it.
- Every fee is reviewed and approved by us before payment. We may withhold or delay payment while we verify a referral, the settlement, your details, or your tax status.
6. Tax
You are responsible for your own tax. A referral fee may be assessable income to you, and you should keep your own records and seek your own advice.
- If you take part as a private individual (not carrying on a business), you may be asked to complete an ATO Statement by a supplier so that we can pay you without an ABN and without withholding.
- If you take part in the course of a business, you should provide your ABN and a tax invoice (or agree to us issuing a recipient-created tax invoice where applicable).
- If you do not provide either a valid Statement by a supplier or an ABN where one is required, we may be obliged by law to withhold tax from your fee, or to withhold payment until the position is resolved.

7. Refunds and clawback
If a referred client's first payment is later refunded, reversed or charged back, the related referral fee is cancelled. If we have already paid it, the amount is owed back to us and we may offset it against any future fees payable to you.
8. How you may promote us
- Share your link honestly. You must not make any misleading, deceptive or unauthorised claim about us, our services, prices, results, licences, insurance or guarantees. Only we may describe what our services do.
- You must comply with the law when promoting us, including the Spam Act 2003 (consent and unsubscribe for any email or SMS you send) and the Do Not Call Register for any calls. Do not send unsolicited bulk messages, spam, or post your link where it is not permitted.
- You must not bid on our brand name in paid search, impersonate us, or present yourself as us or as an official channel.
9. Fraud and disqualification
We may withhold a fee, remove your link, or end your participation if we reasonably believe there has been self-referral, fake or incentivised sign-ups, duplicate or automated accounts, misleading promotion, or any other abuse or breach of these terms. Referrals that we cannot verify as genuine and independent are not payable.
10. Privacy
We handle your personal information (including your contact and bank details, and any tax declaration) in line with our Privacy Policy and the Privacy Act 1988 (Cth). We use these details only to run the program and pay you, we store them securely in Australia, and we do not sell them. We collect only what we need.
11. Changing or ending the program
We may change these terms, or pause or end the program, at any time. Where a change is significant we will take reasonable steps to let you know, for example by email or by updating this page, and continued participation means you accept the updated terms. Any fee already earned under the previous terms will still be honoured.
12. General
- Nothing in this program creates an employment, agency, partnership or joint-venture relationship between you and us.
- Nothing in these terms excludes rights you may have under the Australian Consumer Law that cannot lawfully be excluded.
- These terms are governed by the laws of Australia and the State or Territory in which we are based, and you submit to the courts of that place.
